The following are Terms and Conditions of the Auction.  Please review and if there is any item that you do not understand, please call us at 256.353.7525 or see one of our action staff members at the auction!

Bidding:

All bidding is open to the public.  Everyone must register for a bidder number.  Bidder registration will begin one hour prior to auction.  Down payment accepted in the form of cash, personal or business check, or certified funds.  Auctioneer represents the Seller in all transactions.

Amerisouth Auction, Inc. is acting exclusively for the Seller as Auctioneer and Broker.

Deposits:

At the conclusion or the auction, the high bidder will make a down payment equal to 10% of the Contract Sales Price.  The contract form is in your Auction Information Package for you to review beforehand.  The sale is not contingent upon financing or any other contingencies.  Upon acceptance by Sellers the deposit is non-refundable.  If survey fees apply to a particular tract, they will be due at the time of auction along with the 10% down payment.

Closing:

Balance of purchase price due at closing by Sellers' appointed closing agent within 30 days after the auction.  Seller will prepare a warranty deed.  All other closing costs will be the Purchaser's expense.  Taxes will be prorated from the date of closing. 

Conditions:

A 10% Buyer's Premium will be added to the final bid price and included in the Total Purchase Price. 

All property to be sold "As Is, Where Is", with any and all faults and no implied warranties by Seller or Auctioneer.  The information included herein is a summary of information available from a variety of sources including the Seller, most of which have not been independently verified.  This summary has been provided for the use of the prospective bidders at public auction.  All information and opinions are supplied herein without warranties or representatives, agents, of employees.  Buyers shall rely on their own information, judgment and inspection of the property, records and documents.

All announcements from the auction block will take precedence over any previously printed material or any other oral statements made.  Conduct of the auction and increments of bidding are at the direction of the Auctioneer.  The selling price of each property shall be determined by competitive bidding at the auction.

No property will be sold with contingencies in the contract(s) including any financing company.

From Double Springs: 

At the intersection of Hwy 33 and Hwy 278 in Double Springs, go east on Hwy 278 for 9.3 miles.  Turn right on County Road 63 and go 6.3 miles.  Turn right on Hwy 41 and go 0.8 miles.  Turn left at Arley Public Library and go 1 mile.  Turn right on County Road 12 at Old Nathan Grocery and Deli and go 3.2 miles.  Turn right on County Road 12 and go 3.2 miles to property on right.

From Addison:

At the intersection of Hwy 278 and Hwy 41, go south on Hwy 41 for 9 miles.  Turn left on County Road 77 at Arley Public Library and go 1 mile.  Turn right on County Road 12 at Old Nathan Grocery and Deli and go 3.2 miles.  Turn right on County Road 12 and go 3.2 miles to property on right.

From Cullman:

At the intersection of I-65 and Hwy 278 go west on Hwy 278 and go 20.7 miles.  Turn left on Hwy 41 and go 9 miles Turn left on County Road 77 at Arley Public Library and go 1 mile.  Turn right on County Road 12 at Old Nathan Grocery and Deli and go 3.2 miles.  Turn right on County Road 12 and go 3.2 miles to property on right.

From Jasper:

At the intersection of Hwy 195 and Hwy 78, go north on Hwy 195 for 2.9 miles.  Turn right on Curry Hwy (AL-257) and go 16.0 miles.  Turn right on County Road 77 at Arley Public Library and go 1 mile.  Turn right on County Road 12 at Old Nathan Grocery and Deli and go 3.2 miles.  Turn right on County Road 12 and go 3.2 miles to property on right.
