The following are Terms and Conditions of the Auction.  Please review and if there is any item that you do not understand, please call us at 256.353.7525 or see one of our auction staff members at the auction!  

Bidding:

All bidding is open to the public.  Everyone must register for a bidder number.  Bidder registration will begin one hour prior to auction.  Down Payment accepted in the form of cash, personal or business check, or certified funds.  Auctioneer represents the Seller in all transactions. 

Amerisouth Auction, Inc. is acting exclusively for the Seller as Auctioneer and Broker. 

Deposits:

At the conclusion of the auction, the high bidder will make a down payment equal to 10% of the Contract Sales Price.  The contract form is in your Auction Information Package for you to review beforehand. The sale is not contingent upon financing or any other contingencies.  Upon acceptance by Sellers the deposit is non-refundable.   If survey fees apply to a particular tract, they will be due at the time of auction along with the 10% down payment.

Closing:

Balance of purchase price due at closing by Sellers' appointed closing agent within 30 days after the auction.  Seller will prepare a warranty deed.  All other closing costs will be the Purchaser's expense.  Taxes will be prorated from date of closing.

Conditions:

A 10% Buyer's Premium will be added to the final bid price and included in the Total Purchase Price. 

All property to be sold "As Is, Where Is", with any and all faults and no implied warranties by Seller or Auctioneer.  The information included herein is a summary of information available from a variety of sources including the Seller, most of which have not been independently verified.  This summary has been provided for the use of the prospective bidders at public auction.  All information and opinions are supplied herein without warranties or representations; either expressed of implied whatsoever from Amerisouth Auction, Inc., the Sellers, or any of their respective representatives, agents, of employees.  Buyers shall rely on their own information, judgment and inspection of the property, records and documents. 

All announcements from the auction block will take precedence over any previously printed material or any other oral statements made.  Conduct of the auction and increments of bidding are at the direction of the Auctioneer.  The selling price of each property shall be determined by competitive bidding at the auction. 

No property will be sold with contingencies in the contract(s) including any financing contingency.

Property is subject to be sold before auction.

From Decatur: At the intersection of Hwy 20 and Hwy 67, go west on Hwy 20 for 9.4 miles. Turn left onto CR 53 and go 4 miles. Turn right onto CR 374 and go 1.3 miles to property on right.

From Courtland: At the intersection of Hwy 33 and Hwy 20, go south on Hwy 33 for for 4.9 miles. Turn left onto CR 222 and go 1.1 miles. Turn right onto CR 294 and go 0.5 miles. Turn left onto CR 374 to property on left.

Directions to Auction Site (6464 Mountian Home Road Trinity, Alabama 35673):

From Decatur: At the intersection of Hwy 20 and Hwy 67, go west on Hwy 20 for 3.3 miles. Turn left onto North Seneca Drive and go 1.5 miles then turn right onto Mountain Home Road (CR 222). Go 3.5 miles to property on left.

From Moulton: At the intersection of Hwy 24 and Hwy 157 go east on Hwy 24 for 7.6 miles. Turn left onto CR 434 and go 4.8 miles. At stop sign turn right onto CR 222 and property will be on right.
